Debts that must be paid in a Chapter 13 Bankruptcy Plan

A Chapter 13 Bankruptcy plan that will be confirmed by a judge must show that you will have sufficient income to pay certain debts in full over the life of your plan.  In Utah at a minimum, the following debts must be paid:

  1. All priority debts other than child support owed to a government agency.
  2. All secured debts that are contractually due to end within the life of your plan.
  3. All secured debts that are not contractually due within the life of your plan.
  4. Any arrearages necessary to keep your home, car, or other secured property.
  5. If you have non-exempt property, then any amount equal to that amount.
  6. All administrative expenses, including trustee and attorney expenses.
  7. The remaining amount of your disposable expenses after deducted allowable expenses.

The length of your plan will depend on whether your income is more than the median inform for your state and household.  If you income is less than the median income than your payment plan may last for only three years.  If your income is greater than the median income for your area, then your plan must last 5 years.
